• Must register, obtain a business license and submit an operation and management plan to the Town of Gilbert – registration form.

• Gilbert’s zoning laws allow homes in all residential areas. The Fair Housing Act prohibits discrimination against individuals.

• The law does allow for distancing standards to avoid clustering which could change the neighborhood character. Per state law, there must be 1,200 feet between group/recovery home residences. Read the town code here.

• No. HOAs may not prohibit group homes or recovery residences from locating in neighborhoods, and doing so may constitute a violation of the Fair Housing Act and the Americans with Disability Act.
  
  
• Subject to the provisions of the Fair Housing Act and the Americans with Disability Act, HOAs may require group home owners to comply with CC&Rs.

 Notifications of release from the Arizona State Hospital and placement within a community are not required to be given to residents or the local police jurisdictions.
