The Town Attorney is appointed by the Town Council and serves as the Risk Manager and the Chief Legal Advisor to the Town Council, its Boards and Commissions, and all Town Departments and employees. The Town Attorney's Office does not represent residents and cannot provide legal advice to residents or recommend attorneys.
The Town Attorney’s Office is comprised of three Divisions: the Civil Division, Town Prosecutor Division, and Risk Management Division.
Civil Division
The Civil Division of the Town Attorney’s Office provides legal representation to the Town Council, Town Boards and Commissions, and Town departments and employees related to all legal issues affecting the Town. In its role, the Civil Division focuses on issues relating to local government law, such as public finance, land use, public records, taxation, open meetings, public safety, condemnation, contracts, real estate, employment, environmental, construction, administrative and Constitutional law. The Civil Division is also responsible for drafting or reviewing all legal documents for the Town. In addition, the Civil Division represents the Town in all civil court proceedings. The Civil Division does not provide legal advice to residents, businesses, or the general public.

Prosecutor Division
The Prosecutor Division of the Town Attorney’s Office is responsible for the prosecution of the Town code violations and criminal misdemeanor cases in the Gilbert Municipal Court, including DUI and other criminal traffic violations, domestic violence, shoplifting, and all other misdemeanor crimes committed within the Town of Gilbert.
A Victim Advocate is available through the Prosecutor’s office to assist victims of misdemeanor crimes that occur within the Town of Gilbert.

Risk Management Division
The Risk Management Division of the Town Attorney’s Office is responsible for administering the risk management functions of the Town, including loss fund management, claims administration, administration of insurance contracts, and provision of loss prevention activities.
Risk Management is also responsible for evaluating and processing property and liability claims against the Town. State law (A.R.S. 12-821.01) requires that claims comply with the following requirements:
- Contain sufficient facts to permit the Town to understand the basis upon which liability is claimed; and
- Contain a specific dollar amount for which the claim can be settled and the facts supporting that amount; and
- Mail or hand-delivery to the Town Clerk’s Office within 180 days after a cause of action accrues.
To file a claim against the Town of Gilbert, you may either utilize your own form or complete the Town’s Liability Claim Form. This form is provided to assist in presenting a claim against the Town of Gilbert that complies with the requirements of A.R.S. 12-821.01.
Pursuant to state law, claims may only be filed by either (i) mailing to the attention of the Town Clerk or (ii) hand-delivery to the Town Clerk. Claims that are incomplete, not timely received by the Town Clerk, or not properly filed are statutorily barred and will be denied.
