Vacation rental or short-term rental means any individually or collectively owned single-family or one-to-four-family house or dwelling unit or any unit or group of units in a condominium, cooperative or timeshare, that is also a transient public lodging establishment or owner-occupied residential home offered for transient use (offered for rent for less than thirty days.)

Per Arizona State Law (A.R.S. §9-500.39), short-term rentals are permitted in all municipalities within the state, and by extension the Town of Gilbert. However, State law does not preclude the ability for Homeowner Associations or CC&R’s to regulate or restrict short term rentals within their community.

Yes. All short-term rental properties in Gilbert are required to pay both Transaction Privilege (Sales) Tax and a Transient Tax (bed tax).   Property owners are responsible for obtaining a TPT license from the Arizona Department of Revenue.  Property owners who ONLY book through an Online Lodging Marketplace (OLM) such as Airbnb and VRBO, (with applicable taxes paid by the OLM) must still file a tax return showing the gross receipts received from the OLM with a deduction equal to the amount received from the OLM. A new short-term rental license is $100. The renewal fee is $100 annually. Fees and licenses are per property.

Short-term rental licenses expire annually in the month that you applied. Renewal reminders will be sent through GovOS 60 days prior to your license expiration date.

To cancel your license, please email ShortTermRentals@gilbertaz.gov. Please include the closure date and the reason for closing the license.

If your license application is denied, you have 30 days to submit an appeal via email to ShortTermRentals@gilbertaz.gov. This email must contain the property address and reason for the appeal.

If you use an Online Lodging Marketplace such as Airbnb or VRBO, you will still need to maintain your own TPT license and file your returns, however you would deduct what you would owe using deduction code 775. Yes, you are still required to obtain a Short-Term Rental license through the Town of Gilbert even if you use Online Lodging Marketplaces.

Arizona state law requires that an owner of any type of residential rental property register with the Maricopa County Assessor's Office. Please recognize that this rental property registry is for all types of rentals and does not distinguish between long term and short term or vacation rentals.

If you are not the owner of the property, please first read through your rental agreement and confirm that you are allowed to operate as a short-term rental. If you are, we require written approval from the owner or Property Management Company (PMC) that you are able to operate as a short-term rental. This written approval must be sent to ShortTermRentals@gilbertaz.gov and must be sent from the owner or manager of the PMC. 

If you do not receive a registration letter from GovOS and are currently operating as a short-term rental, please email blt.str.support@govos.com with your property address to obtain further instructions for applying for a license.
